9. Limitation of Liability

To the maximum extent permitted by law, iBIM DigiTech shall not be liable for:

  • project delays caused by third parties;

  • create a conflict of interest;
  • affect our professional relationships or contractual obligations;

Refund Policy

As our services are customized for each client and involve significant planning, technical expertise, and resource allocation, refunds are governed differently from typical e-commerce transactions. By engaging our services, you agree to the following Refund Policy.

1. Nature of Our Services

All services provided by iBIM DigiTech are professional, project-based, and customized according to each client's specific requirements. These services may include, but are not limited to:

Because each project is uniquely developed, refunds cannot be treated in the same manner as physical product returns.

2. Consultation Services

Discovery calls, technical consultations, project assessments, strategy sessions, audits, or advisory services are generally non-refundable once the consultation has been conducted or delivered, regardless of whether the client decides to proceed with a project.

3. Project Payments

All payments made toward BIM projects, consulting engagements, or professional services are subject to the terms outlined in the applicable signed proposal, quotation, work order, service agreement, or contract. The contractual agreement between iBIM DigiTech and the client shall prevail over this Refund Policy wherever applicable.

4. Milestone-Based Payments

Many projects are executed using milestone-based payment schedules. Payments made for completed milestones are generally non-refundable, as they represent compensation for work already performed and resources allocated to the project.

5. Advance Payments

Advance payments or deposits are typically used to reserve project schedules, allocate technical resources, initiate planning activities, and begin project execution. Unless otherwise stated in the signed agreement, advance payments are generally non-refundable after project commencement.

6. Cancellation by Client

If a client chooses to cancel a project after work has commenced:

  • The client shall remain responsible for payment for all work completed up to the cancellation date.
  • Any remaining refundable balance, if applicable, shall be determined in accordance with the signed project agreement.
  • iBIM DigiTech reserves the right to deduct charges for completed work, consultation, planning, resource allocation, software usage, and administrative costs before determining any refund amount.

7. Cancellation by iBIM DigiTech

In rare circumstances where iBIM DigiTech is unable to continue providing agreed services due to unforeseen circumstances, the company may, at its sole discretion:

  • Provide a proportional refund for work not yet performed, or
  • Offer an alternative project delivery arrangement.

8. Change of Mind

Refunds will generally not be provided due to:

  • Change of business priorities
  • Internal budget changes
  • Delay in client decision-making
  • Change of requirements after project commencement
  • Client no longer requiring the services.

9. Delays Caused by Client

iBIM DigiTech shall not be responsible for delays arising from:

  • Late sharing of project information
  • Delayed approvals
  • Missing drawings or models
  • Incomplete project documentation
  • Delayed communication
  • Changes in project scope

Such delays do not qualify for refunds.

10. Scope Changes

If the project scope changes after work has begun:

  • Additional work may require revised pricing.
  • Previously completed work remains chargeable.
  • Refunds shall not be issued for work already completed under the original agreed scope.

11. Project Deliverables

Once project deliverables have been submitted to the client, accepted, or approved, payments relating to those deliverables are generally non-refundable unless otherwise specified in the governing agreement.

12. Disputes and Refund Requests

If you believe a refund should be considered, you may submit a written request including:

Each request will be reviewed fairly and in good faith on a case-by-case basis. Submission of a refund request does not guarantee approval.

13. Contractual Priority

Where a signed contract, Master Service Agreement (MSA), Statement of Work (SOW), Proposal, Purchase Order, or other written agreement exists between iBIM DigiTech and the client, the refund provisions contained in that agreement shall take precedence over this Refund Policy.

14. No Warranty of Specific Business Outcomes

While iBIM DigiTech strives to deliver high-quality professional services, we do not guarantee any specific commercial, financial, operational, or business outcomes resulting from the use of our services. Refunds shall not be granted solely because expected business objectives or project outcomes were not achieved.
